TERMS & CONDITIONS

1/ OBJECT

These conditions of sale are concluded on the one hand by the Japan Fishing Tackle whose registered office is located at Japan and on the other hand by any natural or legal person seeking to make a purchase via the website of Japan Fishing Tackle, (hereinafter “the Buyer” or the “Client”).

These conditions of sale are intended to establish the contractual relationship between Japan Fishing Tackle and the Buyer and the conditions applicable to any purchase effected through the online shop of Japan Fishing Tackle.

The Japan Fishing Tackle will be responsible for taking and delivering orders. Similarly, payments will be made to the Japan Fishing Tackle.

Any order taken in respect of a product appearing on the online shop on the website www.jpnfishingtackle.com implies that these conditions of sale have been read, understood and accepted.

Japan Fishing Tackle reserves the right to modify these general conditions of sale from time to time, having regard to changes in the law. Any modifications made shall become applicable when they are posted online.

2/ SUBMISSION OF THE ORDER

Contractual information will be confirmed by e-mail to the address indicated by the Buyer on the purchase order. The products for sale are those which appear in the catalogue published on the website of Japan Fishing Tackleand which were subject to quality control. Every effort is made to show all the product characteristics by photographs and a product description prepared based on the information provided by the manufacturer. Japan Fishing Tackle undertakes to make its best efforts to describe the products as accurately as possible. However, any errors or omissions in the description shall not entail the liability of Japan Fishing Tackle. The products are offered for sale while stocks last. Stocks being limited in quantity, a notice will be placed on items that are out of stock. However, in the event of error concerning the availability of the article, Japan Fishing Tackle undertakes to refund the Buyer. Certain offers may be made for a short duration, subject to a specific advertisement. The photographs of the catalogue are as faithful a depiction as possible of the product but cannot be an exact depiction thereof, in particular as concerns colours.

On no account may an order be placed by professional salespersons either jointly or severally, for the purposes of their commercial activities, regardless of what means they use to market their products. The Buyer recognizes and accepts that Japan Fishing Tackle reserves the right to refuse an order manifestly placed by a professional salesperson, in light of the number of products ordered in a single order and of the number of independent orders placed for the same product, compared to the usual quantities ordered by the average consumer.

3/ PRICE

A Buyer who wishes to purchase a product online must:

1 – confirm the basket containing his or her order after having verified the contents thereof;

2 – access his or her account by entering the relevant user name and password or register by creating an account and completing the identification form such that it contains all the requested contact information, after which he or she may then proceed to registration;

3 – provide or confirm the billing and delivery address;

4 – confirm his or her order and the payment for such order; and

5 – confirm the payment.

The confirmation of the order entails the full and complete acceptance of these general conditions of sale and the acknowledgement that they have been read and understood in their entirety.
All the data provided and the recorded confirmation shall serve as proof of the transaction. The confirmation shall be equivalent to the signature and acceptance of the transactions made.
Japan Fishing Tackle shall communicate the following information in a first e-mail: the registration and confirmation of the order, the invoice and the delivery time for the order.
Japan Fishing Tackle shall communicate the following information in a second e-mail: the delivery number transmitted to the dispatcher, which allows the Buyer to track the delivery.

4/ CONFIRMATION OF THE ORDER

A Buyer who wishes to purchase a product online must:

1 – confirm the basket containing his or her order after having verified the contents thereof;

3 – provide or confirm the billing and delivery address;

4 – confirm his or her order and the payment for such order; and

5 – confirm the payment.

5/ PAYMENT & SECURITY

Japan Fishing Tacklemaintains its accounts at the MITSUBISHI UFJ Bank.

All information shared for the purpose of processing the payment is encrypted using the SSL (Secure Socket Layer) protocol. These data cannot be detected, intercepted, or used by third parties. They are not stored in our information technology systems.

Payments shall be made by bank card (CB, Visa, MasterCard, American Express, JCB) or through a PayPal account.

PayPal is certified PCI DSS (Payment Card Industry Data Security Standard) by Visa and MasterCard.

The Buyer’s account shall only be debited during the confirmation of payment for the order and during the validation of the amount pertaining to the product and the delivery charges.

6/ DELIVERIES

The products offered for sale are intended for Buyers residing in all countries of the world except for South America.

Once the order is confirmed, the address provided by the Buyer for receipt of the order can no longer be changed.

Neither the dispatcher nor Japan Fishing Tackle may be held liable if the order cannot be delivered on account of a mistake in the delivery address (post box addresses are not an accepted mode of delivery).

Delivery is dispatched by Japan Post and is handovered to the post office in each country or by Fedex or by DHL. The parcel shall only be handed over directly to the intended recipient, against signature. If the intended recipient is absent, a notice of attempted delivery will be placed in the recipient’s letterbox. It is possible to contact each deliverer to arrange a second delivery attempt (contact details to this end are recorded in the notice of attempted delivery).
Standard deliveries to the USA are made within 5 to 8 working days as from the date on which Japan Fishing Tackle hands over the parcel to the dispatcher.

Standard deliveries to the Europe are made within 4 to 9 working days as from the date on which Japan Fishing Tackle hands over the parcel to the dispatcher.

Standard deliveries to the Russian Federation are made within 9 working days as from the date on which Japan Fishing Tacklehands over the parcel to the dispatcher.

Standard deliveries to the Middle East are made within 11 to 13 working days as from the date on which Japan Fishing Tacklehands over the parcel to the dispatcher.

Standard deliveries to the Oceania are made within 6 to 7 working days as from the date on which Japan Fishing Tacklehands over the parcel to the dispatcher.

Standard deliveries to the Asia are made within 5 to 11 working days as from the date on which Japan Fishing Tacklehands over the parcel to the dispatcher.

All standard deliveries will be longer due to unexpected disaster etc. The Buyer may track the delivery at any time on the websites of Japan Post or of Fedex or of DHL using the tracking number previously provided in the e-mail notifying dispatch of the parcel.

In case of a delay in delivery longer than 7 working days after the date indicated upon the placing of the order, the buyer can request investigation. The request shall be made by e-mail to the following address: customersupport@jpnfishingtackle.com.

Delivery charges are as follows:
USD 16.99 - USD 49.99
The amount of the delivery cost shall be indicated in the page “checkout” and is subject to the approval of the Buyer prior to the validation of any order.

All dispatches from our store to countries outside of Japan are conducted in accordance with the laws applicable in the destination country. Upon arrival of the goods in the Buyer's country, customs duties and other taxes may be imposed. All customs duties and taxes shall be the responsibility of the Buyer.

Please be advised that our store cannot be held liable for any additional costs that may arise due to the tax laws of the Buyer's residing country.

7/ RIGHT OF CANCELLATION AND RETURNS

Provided the products are still in their original packaging and have not been used scrached, adjusted and dirtied, the Buyer may cancel the order within 15 days of the delivery of the order.

It is possible to issue a cancellation request by sending an unambiguous statement by Email to customersupport@jpnfishingtackle.com
The Buyer then has 15 days from the notice date to send back the Products to the address given by customer support, the return costs being at the Customer’s expense.

Products must be sent together with invoice (contained in the delivered parcel).

We advise you to use the following courier services: DHL, FedEx or UPS.

Since the physical and shops and the online shops operate independently, it is not possible to return an item to a different network from the one in which it was purchased.

The right of withdrawal does not apply to legal persons.

If the product returned is damaged, Japan Fishing Tackle will return it to the Buyer, who must bear the delivery costs.

Upon receipt of the returned merchandise, the Buyer will be informed by e-mail of the processing of his or her request. Japan Fishing Tackle reserves the right to refuse returned items in the following cases:

– Returns outside the specified time frame, where the right of withdrawal has not been exercised within the time limit of 15 working days.

– Returns that are not consisted with the stipulations, given that products must be returned in their original packaging and state.

After your returned parcel is received and validated, you will be refunded within 15 working days, and you will receive a comfirmation e-mail. The Buyer will be reimbursed for the full cost of the products returned in accordance with the Specified Commercial Transactions Law of Japan. The dispatch costs of the “return” will still be borne by the Buyer.

If you wish to exchange a product, you will have to request a refund and place a new order.

8/ GUARANTEE

Japan Fishing Tackle guarantees the conformity of the merchandise and therefore the Buyer may make a request pursuant to the legal guarantee of conformity provided for the act on Specified Commercial Transactions.

In case of non-conformity of a product sold, the Buyer may choose between the repair and the replacement of the product, subject to the conditions stipulated in act on Specified Commercial Transactions. If it is impossible to repair or replace the product, the Buyer may receive a refund.

The Buyer shall so inform Japan Fishing Tackleby e-mail to customersupport@jpnfishingtackle.com .

The Buyer must return the defective product within 14 days as from the date of delivery of the order. Japan Fishing Tacklewill bear the costs relating to the return.

9/ LIABILITY

In offering goods for sale online, Japan Fishing Tackleshall be bound only by an obligation of means: it may not be held liable for any damages arising from the use of the Internet, such as loss of data, hacking, virus, interruption or other unexpected problems.

As to the failure to perform or the inadequate performance of the contract, Japan Fishing Tacklemay divest itself of its responsibility be proving that it is ascribable either to the consumer or to the unforeseeable and irremediable act of a third party to the contract, or to a case of force majeure. Force majeure encompasses unavoidable circumstances not connected to the parties, despite all reasonable efforts to prevent them. Force majeure also encompasses the immobilisation of means of transport, earthquakes, fire, storms, floods, lightning strikes, the interruption of telecommunications network services, or difficulties inherent in telecommunications networks not linked to the parties.

The party affected by force majeure shall inform the other party within five working days following the date on which it became aware of the force majeure. Both parties shall then agree on the conditions for continuing the performance of the contract.

10/ INTELLECTUAL PROPERTY

No person may reproduce, exploit, disseminate or use for any purpose, even in part, the contents of the website, be they visual or audio. All simple or hypertext links are strictly prohibited except with the prior written agreement of Japan Fishing Tackle.

Accordingly, any copying and use of the Japan Fishing Tackle brand or any parasitism arising from the exploitation of the website shall be automatically prosecuted and sanctioned.

11/ PROTECTION OF PERSONAL DATA

Pursuant to the Japanese data protection law, personal information concerning Buyers may be automatically processed. Within the Japan Fishing Tackle, access to such information may be granted to persons responsible for marketing, the sales service, customer relations and prospecting services, administrative services, logistics and information technology services and their superiors.

Japan Fishing Tackle reserves the right to collect information on Buyers, including by the use of “cookies”.

Buyers may oppose the disclosure of their contact information by notification to the following address: customersupport@jpnfishingtackle.com.

Similarly, users have a right of access and correction of their data, in accordance with the aforecited law. Japan Fishing Tackle undertakes to delete all the contact information and other information of the Buyer upon first request by the Buyer. The data collected may not be used for other commercial ends than those provided for in regard to the website and any other ends that may be subsequently sought by Japan Fishing Tackle. Data used for commercial prospection may be stored for three years with effect from the end of the commercial relationship.

The Buyer has a right of access, modification, correction and deletion of his or her data. To exercise this right, the Buyer must send an e-mail to the following address: customersupport@jpnfishingtackle.com or access the identification page by means of his or her e-mail address and password.

12/ USE OF COOKIES

When the site is being browsed, information concerning the browsing may be recorded as “cookies” saved on the terminal of the person browsing (computer, tablet or smartphone).

13/ APPLICABLE LAW

These conditions of sale online are subject to Japanese law.

In case of dispute, the courts of Kanagawa shall have jurisdiction, regardless of multiple defendants and the involvement of third parties.
